Applicable To: Use of Wavetel technology limited's industrial routers, gateways, software, and related services ("Products").
1. Acceptance of Terms
By installing, accessing, or using our Products, you agree to:
Comply with all local laws (e.g., FCC, CE, RoHS for hardware; GDPR for data)
Obtain necessary operator permissions (e.g., cellular carrier approvals)
Industrial Note:
"Products are designed for industrial environments but must be installed per specified IP ratings and temperature ranges (see product datasheet)."
2. License & Restrictions
2.1 Firmware/Software License
Granted non-exclusive, non-transferable license for device operation
No modification/decompilation allowed (except for interoperability under EU Software Directive)
2.2 Prohibited Uses
Resale/modification without OEM authorization
Deployment in life-critical systems (e.g., medical devices, aviation) unless expressly certified
3. Device Management Requirements
Obligation Industrial Best Practice
Security Change default passwords; enable VPN
Updates Install firmware patches within 30 days of release
Monitoring Maintain event logs for ≥90 days
4. Limited Warranty
Hardware: 2 years for defects (excludes consumables like SIM slots)
Software: 90-day bug fix support for current version
Exclusions: Damage from floods, voltage surges, or unauthorized repairs
5. Liability & Indemnification
5.1 Cap on Liability
Total liability ≤ product purchase price
No liability for consequential damages (e.g., factory downtime)
5.2 Your Indemnity
You will defend us against claims arising from:
Your network security breaches
Violation of export controls (e.g., deploying in embargoed regions)
6. Data & Privacy
Device data collection details: See Privacy Policy
You warrant you have legal rights to transmit data through our devices
7. Termination
We may suspend service if:
You breach cybersecurity requirements
Unpaid invoices exceed 60 days
On termination:
You must return or destroy licensed software
Archived logs will be deleted per Data Retention Policy
8. Law & Disputes
Governing Law: HONGKONG
Dispute Resolution: 30-day negotiation period before litigation
